
LOYALTY & REWARDS PROGRAM – TERMS & CONDITIONS

1. Acceptance of Terms
By enrolling in, accessing, or using the VIA 14 Loyalty & Rewards Program (“Program”), you acknowledge and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not participate in the Program.
2. Program Eligibility
The Program is available to individual customers who:
Are at least 18 years of age; and
Provide accurate contact information; and
Maintain an active customer account in good standing.
Participation is voluntary and free.
3. Earning Rewards
Participants may earn points, punches, credits, or similar rewards (“Rewards”) through qualifying purchases or eligible activities determined solely by EL AGAVE MEXICAN RESTAURANT
Rewards may be issued through:
QR code check-ins
Digital punch cards
Email or SMS engagement
Purchases made directly from EL AGAVE MEXICAN RESTAURANT
Rewards have no cash value, are non-transferable, and may only be redeemed in accordance with these Terms.
4. Redemption of Rewards
Rewards may be redeemed only for the specific products, services, or benefits explicitly listed within the Program.
Rewards cannot be redeemed for cash, store credit, or any cash equivalent.
Rewards cannot be combined with any other discounts, promotions, special offers, coupons, or sales unless expressly stated in writing by business ownership.
Rewards may be subject to blackout dates, inventory availability, service schedule availability, or other reasonable limitations.
EL AGAVE MEXICAN RESTAURANT reserves the right to require proof of identity at the time of redemption.
5. Prohibited Conduct & Abuse Prevention
To protect the integrity of the Program, the following actions are strictly prohibited:
Creating multiple accounts to earn or redeem additional Rewards
Sharing or transferring Rewards between individuals
Uploading fraudulent, altered, or reused receipts
Attempting to manipulate, hack, or exploit the Program system
Misrepresenting personal information
Harassing staff or attempting to pressure staff to redeem invalid Rewards
Any fraudulent, deceptive, or abusive activity, as determined by EL AGAVE MEXICAN RESTAURANT in its sole discretion
If abuse is suspected, VIA 14 may:
Suspend or terminate the participant’s Program account
Void accumulated Rewards
Deny redemptions
Ban the participant from future promotions
Pursue legal or financial remedies if fraud is confirmed
All decisions regarding Program abuse are final.
6. Modifications, Suspension, or Termination
VIA 14 may modify, pause, or terminate the Program at any time, with or without notice.
This includes the right to:
Adjust point/punch values
Change earning or redemption criteria
Modify available Rewards
End the Program entirely
If the Program is terminated, unused Rewards may expire and will not be converted into cash or credit.
7. Communications & Notifications
By participating in the Program, you consent to receive communications from EL AGAVE MEXICAN RESTAURANT via email, SMS, or phone, including:
Reward updates
Promotions
Program changes
Redemption confirmations
You may opt out at any time; however, opting out may limit your ability to receive Program benefits.
8. Data Usage & Privacy
Your participation in the Program is governed by EL AGAVE MEXICAN RESTAURANT Privacy Policy, which outlines how personal information is collected, used, and protected.

9. Receipts & Proof of Purchase
Some Rewards require uploading a valid receipt. A “valid receipt” must:
Come directly from EL AGAVE MEXICAN RESTAURANT
Include date, time, and purchase details
Match the participant’s identity or account
Receipts that are blurred, altered, duplicated, manipulated, or unverifiable will be rejected.
Repeated submission of invalid receipts may result in account suspension.
10. Points & Reward Expiration
Unless otherwise stated:
Rewards expire 365 days after issuance
Expired Rewards cannot be reinstated
Account inactivity for 365 consecutive days may result in automatic expiration of all Rewards
11. Limitation of Liability
EL AGAVE MEXICAN RESTAURANT is not responsible for:
Lost, deleted, or misdirected communications
Technical or system errors
Inability to redeem due to availability or scheduling limitations
Unauthorized access caused by user negligence
To the fullest extent permitted by law, EL AGAVE MEXICAN RESTAURANT disclaims all liability for damages arising from participation in the Program.
12. Governing Law
These Terms are governed by the laws of the State of Georgia (or update per client location). Any disputes shall be resolved in the courts of the applicable jurisdiction.
